ExProTrack is operated by ExProTrack. These Terms of Service explain the rules for using ExProTrack, a cloud-based SaaS platform for construction project expense tracking, budget management, and approval workflows. ExProTrack is a software-only platform and does not provide human-delivered professional services such as consulting, advisory, or managed services.

Acceptance of Terms
By accessing or using ExProTrack, you agree to these Terms. If you create an account or subscribe on behalf of a company or other business entity, you represent that you have authority to bind that organisation to these Terms.

Description of Service
ExProTrack is a cloud-based software service for construction project expense capture, budget monitoring, approval routing, receipt storage, and VAT-related reporting. The service is a software-only SaaS platform and does not involve any human-delivered professional services.

Account Registration
You must provide accurate, current, and complete registration information and keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your organisation's account. ExProTrack is available only to users who are at least 18 years old or are acting on behalf of a business. Each organisation must maintain its own separate account and may not share access with another organisation.

Subscription and Billing
Subscriptions are billed monthly or annually in advance via Paddle, our authorised reseller and Merchant of Record. Paddle handles payment processing, invoicing, and applicable tax collection. Prices shown by ExProTrack exclude applicable taxes unless stated otherwise. Paddle may add VAT, GST, sales tax, or similar charges as required by law. Annual subscriptions are billed as a single upfront payment for the full annual term.

Free Trial
ExProTrack offers a 14-day free trial with no credit card required. At the end of the trial period, you must subscribe to a paid plan to continue using the service. Trial accounts that do not convert will be locked at expiry. Trial data is retained for 30 days after trial expiry to allow you to subscribe and recover your workspace.

Cancellation
You may cancel your subscription at any time from your account settings. For monthly plans, service access continues until the end of the current billing period and no further charges will be made. For annual plans, cancellation stops renewal at the end of the term; refunds are available as described in the Refund Policy and as provided by Paddle as Merchant of Record.

Acceptable Use
You may not use ExProTrack to store or transmit illegal content, violate another party's rights, attempt to reverse-engineer or bypass security protections, share login credentials across organisations, or interfere with the availability, integrity, or performance of the platform for other users. We may suspend accounts that create security, abuse, or compliance risks.

Data and Privacy
We collect and process personal data and business data as described in our Privacy Policy. You retain ownership of the data you upload to ExProTrack, including expense records, project details, and receipt files. You grant us a limited right to host, process, back up, and transmit that data as necessary to provide the service, support your account, comply with law, and maintain security. You may export or delete your data at any time using the features provided or by contacting support.

Data Retention on Cancellation
After cancellation of a monthly subscription, your data is retained for 60 days so that you can export it or reactivate the service. After that period, the data is permanently deleted from active systems. For annual subscribers, data is retained until the annual term ends and then for an additional 60 days before permanent deletion.

Service Availability
We target 99.5% monthly uptime for ExProTrack. Planned maintenance will be notified at least 24 hours in advance whenever reasonably possible. If unplanned downtime exceeds 4 hours in a calendar month, your sole and exclusive remedy is a service credit equal to the pro-rated daily subscription fee for each full hour of unplanned downtime beyond that 4-hour threshold.

Limitation of Liability
To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to these Terms or the service will not exceed the total fees paid by you in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, goodwill, or data.

Intellectual Property
ExProTrack, including its software, brand assets, documentation, website content, and all related intellectual property rights, is owned by the operator or its licensors. Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the service during your subscription period for your internal business operations.

Governing Law
These Terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of courts in Thrissur, Kerala, India.

Changes to Terms
We may update these Terms from time to time. If a change is material, we will provide notice by email at least 14 days before the updated Terms take effect. Continued use of the service after the effective date of the updated Terms constitutes acceptance of the revised Terms.
