ExProTrack Terms of Service

These Terms of Service (“Terms”) explain how you may use the ExProTrack web application, website and related services (together, the “Service”).
The Service is operated by ExProTrack, a sole proprietorship of Abu Bilal, based in Kerala, India (“ExProTrack”, “we”, “us”, “our”).
By creating an account, starting a trial or using any part of the Service, you agree to these Terms. If you do not agree, you must not use the Service.
1. What ExProTrack does
ExProTrack is a software-as-a-service tool that helps construction and project teams track budgets, daily expenses and simple reports for projects. The Service is intended for business use, not for personal household budgets.
2. Who may use the Service
- You must be at least 18 years old to use the Service.
- If you use the Service on behalf of a company, you confirm that you have the right to accept these Terms for that company.
- You are responsible for making sure that your use of the Service follows all laws that apply to you.
3. Accounts and access
- You must keep your login details secret and secure.
- You must ensure that all information you provide is true, correct and kept up to date.
- You are responsible for all activity that happens under your account.
- If you think your account has been used without your permission, you should change your password and contact support@exprotrack.com as soon as possible.
4. Plans, payments and Paddle
Paid plans for ExProTrack are sold as subscriptions. Plan types and prices are shown on our Pricing page or inside the app.
We use Paddle.com as our payment partner and Merchant of Record. This means that:
- Paddle sells the subscription to you on our behalf.
- Paddle handles card charges and other payment methods.
- Paddle calculates, collects and pays any VAT, GST or other sales taxes where required.
- Your invoice or receipt will show Paddle as the seller of record.
By starting a paid plan you also agree to Paddle’s buyer terms and payment policies, which are shown during checkout.
5. Billing, renewals and price changes
- Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date.
- Paddle will charge the payment method you selected at sign-up or later update.
- If a charge fails, Paddle or we may suspend or limit access to the Service until payment is successful.
- If we change prices for your plan, we try to give reasonable advance notice. New prices normally apply at your next renewal.
6. Free trials and test access
From time to time we may offer free trials or test access. We may start charging at the end of a trial if this was clearly stated when you joined, and you did not cancel before the trial ended.
We may change or end a trial offer at any time.
7. Refunds and cancellations
Our approach to refunds is explained in the Refund Policy. Where a refund is approved, it is processed by Paddle because they collected the original payment.
You may cancel your subscription at any time. Unless our Refund Policy says otherwise, access continues until the end of the current paid period and then stops. We do not give refunds for unused time in a billing period unless the Refund Policy states this.
8. Your content and data
- You keep ownership of the project data and content you enter into the Service.
- You give us a limited right to store, back up and use that data only as needed to run the Service, support you, meet legal duties and develop the Service.
- You confirm that you have the right to upload the data you store in ExProTrack and that it does not break any law or the rights of others.
9. Privacy and security
Our Privacy Policy explains how we collect, use and protect personal data and project data. By using the Service, you agree that we may handle data in line with that policy.
We use reasonable steps to keep the Service secure, but no system can be fully safe. You are responsible for keeping your own devices and network safe and up to date.
10. Acceptable use
You must not use ExProTrack to:
- break any law or regulation;
- store or share harmful, abusive or hateful content;
- send spam or other unwanted messages;
- try to gain access to systems or data without permission;
- try to avoid payment or bypass billing or security limits;
- copy, resell or re-package the Service without written consent.
11. Intellectual property
The Service, its design, logo, code and content (other than your data) belong to ExProTrack or our licensors. We give you a limited, non-exclusive, non-transferable right to use the Service for your internal business use while you follow these Terms and pay all fees due.
You must not copy or reverse engineer the Service or try to build a competing product using our code or designs.
12. Third-party services
The Service may link to or work with services run by others, such as Paddle for payments or hosting providers. We are not responsible for those third-party services and they may have their own terms and privacy rules.
13. Changes, suspension and termination
- We may update or change parts of the Service from time to time.
- We may suspend or limit access if you break these Terms, fail to pay fees, or if we have security or legal concerns.
- You may stop using the Service at any time. If you want to fully close your account you can contact support@exprotrack.com.
14. Warranties and disclaimer
The Service is provided on an “as is” and “as available” basis. We do not promise that the Service will be free from errors, or that access will always be without interruption.
We do not give legal, tax, or accounting advice. You should get your own professional advice where needed.
15. Limitation of liability
To the extent allowed by law, ExProTrack and its owner will not be responsible for any lost profits, lost data, loss of business, or indirect or special damage that comes from using or not being able to use the Service.
Where the law does not allow us to exclude all liability, our total liability for all claims linked to the Service will be limited to the fees you paid for the Service in the twelve (12) months before the issue happened.
16. Your responsibility to us
If someone makes a claim against ExProTrack because of your use of the Service, your data, or because you broke these Terms, you agree to cover our reasonable losses and costs (including legal fees) as long as we tell you about the claim and, where fair, let you help handle it.
17. Governing law and disputes
These Terms are governed by the laws of India. Any dispute will be handled by the courts of Kerala, India, subject to any rights you have under mandatory local law.
18. Other important terms
- If any part of these Terms is found to be invalid, the rest will stay in effect.
- If we do not enforce a right straight away, it does not mean we give up that right.
- You may not transfer your rights under these Terms to another person without our written consent.
